Legislative pays super salaries

The Parana’s Government Assembly paid to 73 persons salaries higher than maximum allowed by law in case of Parana’s legislative (R$ 20 thousand), between 2004 January and 2009 April. Were 641 deposits in bank accounts, what totalized R$ 59,6 million.

From the benefited ones of super salaries, 41 are in the list published by the House in April of 2009. From these, 35 are commissioned government employees – positions placed without the necessity of a public contest. Nineteen persons don’t appear any time in more of 700 official diaries from the Assembly checked by Gazeta do Povo and RPCTV’s report – what means that, officially, couldn’t either be House’s employees.

The report searched some of this people. Among them, there is a taxi driver, waiter, bricklayer, business executive and lawyer.

Some of them even imagine the money volume that is moved in their accounts. Part of them said that never have worked in Assembly. Other ones even live in Parana. These are strong reasons that, beyond the salaries above the law allow, there are phantom public employees, benefits to politics sponsors and a possible scheme that uses innocent people as straw mans for public money deviation.
 
Salaries Champion

In the top of the list of super salaries is the driver Wilson Schabatura, of 76 years old, that has R$ 1,316 million credited in his account from 2004 to 2009. Last week, the report was at Schabatura’s house, in the city of São José dos Pinhais, next to Curitiba, to hear him. But the house was rented to a known family of the driver. The residents informed that Wilson Schabatura is living in Porto Seguro, in Bahia. The phone number of Bahia phone list, in name of the driver, nobody answered. His children, Carlos Girney and Sérgio Antônio, also received higher quantities from Assembly. Carlos received R$ 903 thousand, and his brother R$ 1,2 million – in the period from 2004 to beginning of 2009.

Wilson Schabatura and the son Sérgio are in the relation of government employees of Assembly, published march of 2009. But Carlos is not in the list. Also, name doesn’t appear on the consulted diaries by Gazeta do Povo and RPCTV team. 

Bibinho

Part of people that received super salaries from Assembly in same way are connected to the general director of the House, Abib Miguel, knew as Bibinho. The couple João Maria Vosilk and Solange Alves Nogueira could have deposited in their accounts, from 2004 to 2009, R$ 2,6 million. João Maria is bricklayer and son of Izidoro Vosilk – the gardener who works at Bibinho’s house, at Seminário neighborhood, in Curitiba, as showed by Gazeta do Povo and RPCTV yesterday. At João Maria bank account was deposited R$ 1,298 million. But the diaries from 2006 to 2009 never recorded that the bricklayer was a public employer of Assembly.

João Maria’s wife, Solange, appears on the Assembly’s employers list, but she recognizes that works in a store. But, the fact is that Assembly deposited R$ 1,311 million in her account from 2004 to 2009.

From Gbur family are 2 persons – Pierre and Alessandro – that received together R$ 2,6 million from Assembly in the period (R$ 1,291 million to Alessandro’s account and R$ 1,282 million for Pierre).

The official diaries from House show that Pierre Gbur was hired to work at general-directory’s office, of Bibinho’s responsibility. The documents don’t show Pierres demission, but the deposits show that the link still remains.

Pierre works as a waiter at a night club in Curitiba and lives in a simple house at Boqueirão neighborhood. He received the report at his house entrance and admitted that never worked in Legislative. “I’m a waiter”, said. Denied also that received money from Assemblyv. I don’t have knowledge of the deposits. If I have stayed with this money, my car would not be in order to be pursued and to apprehension”.

The situation of Clori de Oliveira Gbur, the waiter’s mother, is similar. The assembly done two deposits of R$ 35 thousand in august of 2006 and, two months later, one more in the value of R$ 31 thousand. From 2004 until the beginning of 2009, Clori’s bank account received R$ 1,1 thousand from Assembly. The report doesn’t found Clori, but her son, Pierre Gbur, said that she is retiring and works at a healthy station. According to him, the woman didn’t receive money from Assembly.

Yesterday, Gazeta do Povo and RPCTV already had showed other cases of people linked to Bibinho in whom accounts were deposited quantities that exceeds the constitutional established. Lorete Prevedelo Pequeno Cury had deposited in her accounts until R$ 35 thousand monthly. Between 2004 and beginning of 2009, were R$ 1,2 million. She, who lives in Balneário Camboriú (SC), is daughter of Douglas Bastos Pequeno, counter of Bibinho in Goiás state.

Gina Prevedelo Pequeno, Lorete’s sister, also received in her accounts quantities higher than R$ 20 thousand in some months, between 2004 to 2009, as well as her son, Erick Salles. Viviane Bastos Pequeno, daughter of the current wife of the counter of House’s general director, is also in the super salaries list.

The Bibinho’s sister-in-law, Josemi de Lara Cichon, is another one in super salaries list. In her account the direction deposited R$ 460 thousand from 2004 to beginning of 2009. Josemi doesn’t appear as public employee from Assembly in the official diaries. The report searched for the Legislative general-director to hear about employers that receive super salaries, but didn’t have return.

Academical in Santa Catarina received salaries

Aguinaldo Pereira Lima Neto, of 28 years, studied Environment Engineering at Vale do Itajaí University (Univali), in Santa Catarina state, from 2002 to 2005. In the period, the Legislative Assembly of Parana deposited R$ 520 thousand in his bank account. To be possible conciliate the job at Assembly and the studies in Itajaí, Lima Neto would have to travel 220 kilometers every day, around three ours of travel. He is grandson of the ex-mayor Siqueira Campos (Pioneer North) and ex-state congressman Agnaldo Pereira Lima, already died.

Lima Neto figures as one of the persons that received some monthly payments from Assembly above of the legal established between 2004 to 2009 years. Obtained documents by report reveal that in may and September of 2006, the Assembly deposited salaries to Lima Neto above of R$ 30 thousand.

Today, he is owner of a bar in Curitiba. The Lima Neto’s name appears in Assembly’s employers list, published in 2009. He was searched last week to explain the higher deposits and if he really goes to Assembly, considering that during the commercial hour he was at the bar and later, went directly to home, but, he refused to talk.
 
For specialist, payments are illegal

The payment of salaries above R$ 20 thousand at Assembly of Parana is illegal, say the specialists heard by the report. According to article 37 of Federal Constitution, the payments (which include salaries and other benefits) to public employers of legislative assemblies can’t exceed the value paid for a state parliamentarian. In case of Parana’s legislative, the established value would be R$ 12,2 thousand, which is the congressman value.

But some specialists in Law defend, base in article 27 from constitution, a less restrictive view. In this interpretation, the values of a state congressman can’t be higher than 75% of the maximum allowed to finance a federal congressman, that can be until R$ 26,7 thousand (actually, today the value is lower than this). So, for this group of specialists, the maximum that an employee of Assembly could receive would be R$ 20 thousand – value considered in this report as comparative to define what is “super salaries”.

Mamede Said, master degreed in Public Law from Brasília University, defends that the situation of high salaries of Assembly of Parana is inappropriate. “Is clearly illegal”. But Christiano de Oliveira Taveira, also master degreed in Public Law, says that the Rio de Janeiro Assembly had problems in a recent past with payments done above the established. The exceed values finished to be blocked. The Public Ministry sued the Assembly. The situation is still managed by Justice.
